INTRODUCTION
These terms apply to Users who use the Site to sell products.
These Terms, together with our Privacy Policy and Terms of Use, tell you the legal terms and conditions on which the Products can be sold. The Seller Terms and Conditions, Privacy Policy and Terms of Use are together the "Agreement".

The terms "us", "our" "we" or "HHH" refer to High Heel Hierarchy Ltd. The term "you" refers to the user or viewer of our Site.

Please read these Terms carefully and make sure you understand them, before selling any Products. Please note that by selling any Products in accordance with section 5, you agree to be bound by these Terms and the other documents expressly referred to in them.

We amend these Terms from time to time. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated in June 2024.

About You

If you are a seller then references in these terms and conditions (the "Terms") to "you" are to the individual using our website and selling the products detailed on our website ("Products") for private and non-commercial purposes.

Glossary

In these Terms:

"Buyer" means a purchaser of a Product on the website from a Seller;
"Account" means a customer account which has been opened by you through our website;
"Order" means an order for a Product placed on the website;
"Seller" means the seller of a product, being a consumer seller;
"VAT" means Value Added Tax;
"VIP Item" means a Product listed for sale by a Seller using the VIP Service;
a person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality);
a reference to a party includes its successors or permitted assigns;
a reference to a statute or statutory provision is a reference to such statute or statutory provision as amended or re-enacted. A reference to a statute or statutory provision includes any subordinate legislation made under that statute or statutory provision, as amended or re-enacted;
any phrase introduced by the terms including, include, in particular or any similar expression, shall be construed as illustrative and shall not limit the sense of the words preceding those terms; and
a reference to writing or written includes emails.

The role and responsibility of HHH
The Users hereby acknowledge that, save where otherwise specified for any given Products that are on offer on the Site, the role of HHH shall be limited to acting as an intermediation platform between the Users. To that end, save in case of specific circumstances, shall not act as reseller of the Products and shall not become the owner of the Products at any point in time.

Each Users shall act, at all times, for and on its own behalf and shall never act as an agent or representative of HHH. HHH shall not be party of the contract of sale between the Buyer and the Seller, and hereby disclaims liability for such contract or for its consequences.

Any quality control potentially performed by HHH shall merely relate to whether the Seller's product is in keeping with its description in the Product page drawn up by the Seller. HHH shall not check whether the Product or the description of the Product or the description of the product on the Seller's Product page meets the Buyer's expectations. Therefore, HHH does not guarantee that the Buyer shall find the Product satisfactory, whether from an aesthetic point oft view or from a practical point of view, as to its use.

Any deliveries that are arranged by HHH and fulfilled by its subcontractors shall not imply that HHH is a party to the contract between the Seller and the Buyer.

With the exception of any complaints for late delivery or for failures to deliver Products that may be blamed on HHH, it is up to the Seller to respond to any claim or complaint regarding the products that they have advertised online.

The Seller's Commitments and Obligations

The Seller undertakes to sell only Products of which they are the sole owner.

The Seller hereby represents that they are not violating laws and regulations in any way and are not infringing the rights of any third parties.

The Seller warrants, represents and undertakes that the origin, the condition and the characteristics of the Product that they offer on the Site for sale comply with the description of that Product on the corresponding Product Page and that the Product that is offered for sale is not counterfeit.

The Seller shall be the only person responsible for the sale of the Product.

Seller Fees

The services on offer by HHH shall be remunerated by Selling Fees that HHH shall deduct from the price of the Product Paid by the Buyer.

Selling Fees: 25% of the sale price - this includes all external processing costs of your transaction.

2) How do I sell on HHH?

Products sold by Sellers under 'The Private Sale' will only be available to buyers in the United Kingdom.

Log in or register for an account, then Select 'Add new product' in your account, and follow the simple steps.

Once you have completed your listing, select 'Submit for review' and your item will go to the HHH team for approval to go live on the site.

We aim to review your submission within 72 hours, and we will contact you if there are any issues regarding your listing.

The Seller may alter the Price of the Product, in which case the Seller Fees of HHH shall be adjusted.

Please note: the price of an item will be automatically reduced by 10%, after each month, if it has not sold. You will be notified about this reduction, and you will be able to remove the item from sale if you so wish.

Items will be offered for sale to members of our private Whatsapp group and will be advertised via our weekly email newsletter and social media platforms.

Guidelines

The Seller undertakes to comprehensively, honestly and accurately describe the Product's characteristics, its brand, and any faulty workmanship, damage or wear, or other attribute of the Product that the Buyer would reasonably want to know at the time of buying the Product.

When considering prices, please keep in mind the following points: condition, desirability and age. We suggest you check similar items already listed on HHH, for guidance. It is at HHH's discretion to allow or disallow a seller's asking price.

In your listing, please be honest about the condition of the item. If the item has marks or is slightly damaged, state this in the listing and provide photographs. This is very important, because if the item is sold ‘not as described’, the buyer may return the item for a full refund. EVEN THE SMALLEST MARKS OR SCRATCHES MUST BE ACCURATELY DESCRIBED.

Please include as much detail as you can in your listing, especially measurements and size information... it will help your item to sell.

Please note:

Always photograph the entire item, keep the background simple and avoid blurred or filtered images.
Clear, detailed photos improve browsing and increase selling potential.
Do not upload any images which you do not own or have permission from the owner to upload.
All proof of authenticity should be included in your images, from receipt to ribbon.
State clearly all the items that will be included, such as the original box, dustbag, heel tips, authenticity card etc..
ALTERING A PRODUCT PAGE

The Seller may add comments and additional photographs of a Product that is listed on the Site, after publication of the Product Page on Web Site. Any addition of images shall be subject to validation by HHH.

What can I sell on HHH?

We accept high-end designer items which are unworn or in very good condition.

The most important thing is the authenticity of all items listed on HHH, therefore the seller must be sure of the authenticity before listing.

In addition to this, all items will be screened by our team before being set live. If we are unable to confirm the authenticity of an item, the item will be declined and will not be offered for sale on the HHH website.

All clothes should be dry-cleaned before listing.

We allow most high-end designers such as Alexander McQueen, Burberry, Balenciaga, Bottega Veneta, Celine, Chanel, Chloe, Christian Louboutin, Dior, Dolce & Gabbana, Fendi, Gucci, Hermes, Jimmy Choo, Louis Vuitton, Prada, Stella McCartney, Valentino, Missoni etc.

How should I decide the price of the items I'm selling?

When contemplating prices, please have a look at the price of similar items already listed on HHH.

You may also consider the RRP, the condition, the desirability and the age of the items.

When will my listing be approved?

Your item will be reviewed within 72 hours, and we will contact you if there are any issues regarding your listing.

Why would an item be refused for sale by HHH?

Before publishing a listing, the description, photographs and price of the item are carefully reviewed by our team. They check that an item:

Is by one of our approved designers
Is in very good condition
Is authentic

If an item does not fulfil the criteria, it may be rejected. The team may also reject items which have been altered or customized or if we cannot establish authenticity.

We reserve the right to reject an item without any explanation.

Can I edit my listing?

You can edit all details and add/change images without removing your item from sale.

Any increase in the price of an item must be approved by the HHH team.

HHH may suggest that the Seller alter the Price of the Product in order to make it coherent with the prices of the Products listed on the Site and with the market's expectation in general.

If you have any issues, please contact us and we will we happily explain the process in more detail or edit the item for you.

OPTION FOR HHH TO ACQUIRE THE PTODUCT DIRECTLY

In exceptional cases, after negotiations over the Price, HHH may offer to acquire the Seller's Product directly.

Payment Protection

Payments are not released to the seller until the buyer confirms receipt of their order as described. Buyers have 3 days after delivery to inform us if the item has been misrepresented by reporting the problem to HHH with supporting photos. If the claim is verified the buyer will be asked to ship the item back to the seller within 5 days of approval to be eligible for a refund.

The payment is released after 5 days of the seller receiving the item unless an issue is reported.

If tracking shows the order was received by someone other than the buyer, payment may be delayed while we confirm with the buyer that their order has been received.

If your buyer informs us an item has not arrived, payment will be held until it has been received. If an item is deemed lost in transit, the buyer will receive a refund.

It is the seller's responsibility to contact the shipping service they have used to track down undelivered parcels.

If no claim is made within 5 days of delivery, payment will be automatically released to the seller. Once payment has been released, all sales are final and no refunds will be provided.

Shipping

Congratulations on your sale!

If you receive a notification that a someone has bought an item you are selling, you should dispatch it within 72 hours.

No matter what the item, we recommend you clean the item before shipping it. Clothing should be dry-cleaned, shoes shouldn't carry any dirt and jewelry should sparkle.

Package your item securely with sustainable materials which will protect the item you are sending.

Don't forget to include any additional items, such as a dust bag or authenticity certificate.

When you are happy that the package is complete, send it using tracked insured shipping, we recommend either Royal Mail Special Delivery or UPS tracked an insured.

When you have sent your item, go to your HHH account and set the item as shipped, adding the tracking details as you do so. Without a legitimate tracking number we will not be able to pay sellers as this is our protection against dishonest buyers.

How long do I have to ship an item I have sold?

Once a sale has been confirmed, you have 72 hours to send the item to the buyer.

If you are unable to send the item within that time frame, email [email protected] to let them know.

If you do not send the item within 72 hours, the sale may be cancelled and the buyer reimbursed.

If you are on holiday and you have submitted your holiday dates, your sale will not be cancelled, unless you or the buyer request it.

Remember, the quicker you send your item, the sooner you will be paid.

Returns and refunds

Do I have to accept returns?

HHH operates a flexible returns policy for our private sellers, and they are not obliged to accept return unless the item is not as described or damaged. In all cases where a return is accepted, the buyer will cover the cost of return even if an item is faulty, damaged or not as described. Please bare this in mind when making a purchase.

Even if you do not choose to accept returns, if an item is incorrectly listed, the buyer is entitled to a refund.

Should the transaction be cancelled due to the item being found counterfeit or not as described, HHH shall bill the Seller a fixed fee of twenty five pounds (£25) processing fee, corresponding to the minimum 'handling' costs.

Consequences of impossibility to deliver the Products

1. If dispatched through HHH

If it is impossible to return a product that is not compliant to the Seller (incorrect address), an email shall be sent to the seller. The Product will then be kept by HHH for one (1) month. If the product is not claimed within the specified period (1 month) , the product shall then be re-listed under HHH's account on the site, destroyed or donated to charity.

Should the Seller wish to retreat their Product, they must request this by contacting HHH customer service and make a bank transfer of twenty five pounds (£25). After receipt of the payment, HHH shall send the Product back to the Seller within fifteen (15) days.

2. If dispatched through Seller

If it is impossible to deliver a Product to the Buyer (e.g incorrect address), the parcel shall be returned to the Seller in keeping with the terms of the carrier selected by the latter.
